Sets by Hand Seller Terms

Last updated: [DATE]

The short version

  • You run your own business. Sets by Hand is the marketplace that brings you customers, takes payment, and handles labels and support.
  • You pay 0% on customers who come through your own shop link, QR card or artist code. Founding artists: your first 10 orders from customers we find for you are fee-free. After that, customers we find for you have a commission: 15% on their first order with you, 9% on repeat orders. The card processing fee (2.9% + 30 cents) is yours on every order.
  • You get paid through Stripe to your bank, 3 days after the set is delivered.
  • Before you ship, take two photos: the set next to the order slip, and the sealed package. These protect you.
  • You own your designs. Only upload work that is yours.

1. About these terms

These Seller Terms are an agreement between you and [COMPANY LLC] ("Sets by Hand", "we", "us"). They apply when you apply to sell, open a shop, or sell sets on Sets by Hand. Our Terms of Service, Content and Upload Rules, Reviews Policy, Refunds, Remakes and Returns Policy, Shipping and Lost Packages Policy, and Privacy Policy also apply to you. If these Seller Terms conflict with the Terms of Service on a seller topic, these Seller Terms win.

You must be at least 18 and legally able to run a business in the US to sell on Sets by Hand.

2. Your status: an independent seller

2.1 You are independent. You are an independent business, not an employee, agent, partner, or joint venturer of Sets by Hand. You decide your own designs, prices (within our listing rules), schedule, tools, supplies, and how you make your sets. You can sell anywhere else you like, including your own website and other marketplaces.

2.2 What we do. We provide the marketplace: your shop page, listings, checkout, payment processing through Stripe, prepaid shipping labels, and customer support.

2.3 No benefits. Because you are independent, you are not eligible for employee benefits, and we don't withhold income taxes for you.

3. Getting started

  • Apply through the site. We review applications and may approve or decline at our discretion.
  • Set up a Stripe Connect Express account. By doing so, you agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Stripe may ask you for identity and banking information.
  • Provide accurate business and contact information and keep it up to date.

3.1 High-volume seller information (INFORM Consumers Act). Federal law requires us to collect and verify certain information from "high-volume" sellers (generally 200 or more sales and $5,000 or more in revenue on our platform in a 12-month period). This includes bank account details, a tax ID, and contact information. For sellers above certain sales levels, the law requires us to show some of this information to buyers. We'll contact you if this applies to you, and we may pause payouts until you provide it.

4. Commission and fees

4.1 Commission rates. We charge a commission on each order. The rate depends on how the customer found you:

How the customer found youCommission
Your own customer, ordering through your personal shop link, QR card or artist code0%
A customer Sets by Hand found for you: first order with you15%
A customer Sets by Hand found for you: repeat orders with you9%
Founding artists: your first 10 orders that we find for you0%

4.2 What commission applies to. Commission is a percentage of the set price plus add-ons you sell (like spare nails or rush). It does not apply to shipping, order protection fees, or sales tax. Discounts from Sets by Hand promo codes are paid by Sets by Hand: your earnings and commission use the full set price, so a code never lowers your pay.

4.3 How we decide who found the customer. An order counts as yours when the shopper's first visit to Sets by Hand started on your shop link or QR card (we remember this for 90 days), or when they enter your artist code at checkout. All other orders count as found by Sets by Hand. When a shopper Sets by Hand found orders from you again, that order uses the repeat rate.

4.4 Payment processing fees. Card processing fees charged by our payment processor (2.9% + 30 cents per order, figured on the whole order total the customer pays, including shipping and order protection) are deducted from your payout on every order, including orders with 0% commission. They go to the payment processor, not to us.

4.5 Shipping labels. We buy USPS labels for your orders through our shipping partner (Shippo). You don't pay for standard labels on normal orders. You may be charged for extra labels you request because of your own mistakes (for example, a misprinted or lost label).

4.6 Changes to rates. We'll give you at least 30 days' notice by email before we raise commission rates. Changes don't apply to orders placed before the change.

5. Payouts

5.1 When you get paid. Customer payments are collected by Sets by Hand through Stripe. Your earnings for an order (the amount the customer paid for your set and add-ons, minus commission and any applicable fees) are held until the package is delivered. They are released 3 days after tracking shows delivery, which gives the customer time to report a problem. Stripe then pays out to your bank on your payout schedule.

5.2 If tracking never updates. If tracking stops updating but your proof photos are in order, we'll release your earnings [14] days after the ship date, unless there's an open claim.

5.3 Holds and deductions. We may hold or deduct earnings when:

  • A customer opens a claim on the order (held until resolved).
  • A claim is approved because of your error (wrong sizes vs the order, wrong design, defect). In that case you either remake the set or the refund is deducted from your earnings.
  • A chargeback is filed on your order and you are responsible under our policies.
  • We reasonably suspect fraud or a breach of these Seller Terms.

If your balance can't cover a deduction, we may take it from future earnings.

5.4 Lost packages are not on you. If a package is lost in transit and your two proof photos and shipping scan are in order, you still get paid. Sets by Hand handles the customer's replacement or refund.

6. Making and shipping orders

6.1 Make time. You set your make time (in business days) on your shop and listings. You must ship each order by its ship-by date (order date plus your stated make time, or the rush date for rush orders).

6.2 Late orders. If an order hasn't shipped by its ship-by date plus [5] business days, the customer can cancel for a full refund. If you miss a rush ship-by date, the rush fee is refunded to the customer and not paid to you.

6.3 Two-photo proof (required). Before shipping every order, upload two clear photos to the order page:

  1. The finished set, laid out in order, next to the printed order slip.
  2. The sealed package, ready for its label.

Orders without both photos may not be covered by our seller protections. If a customer reports a problem and you don't have proof photos, we may decide the claim in the customer's favor.

6.4 Use our labels. Ship every order using the label from the site so tracking stays connected to the order.

6.5 Customer information. You may use a customer's name, address and sizes only to make and ship their order. Don't add them to marketing lists, contact them outside the site, or share their information, unless they clearly agree. Delete or shred printed order slips and addresses you no longer need.

7. Quality standards

Every set must:

  • Match the listing photos in design, color, shape and length, apart from normal handmade variation.
  • Match the sizes on the order exactly.
  • Be new and never worn or tried on by anyone.
  • Be made in a clean workspace with clean tools.
  • Be packed securely so nails don't break in the mail.
  • Include anything listed in the order (for example, glue, tabs, file, cuticle stick, spare nails).

You must list the main materials in your sets (for example, gel, acrylic, polish type, gems, and the type of glue or tabs you include).

8. Cancellations

8.1 Customer cancellations. Customers can ask us to cancel for a full refund until you accept the order or [2] hours after ordering, whichever comes first. [Decision for Ryan: confirm this cancel window.]

8.2 Your cancellations. If you can't make an order, cancel it as soon as possible through the site. The customer gets a full refund. Frequent cancellations hurt your shop standing and may lead to review or suspension.

8.3 Waitlists. If you are fully booked, you can turn on a waitlist. Only open spots you can truly fill on time.

9. Remakes and claims

You get the first chance to respond to a customer claim, usually within 2 business days. If you can't agree with the customer, Sets by Hand decides based on our policies, the order, photos and tracking. Our decision is final for platform purposes.

  • Your error (sizes don't match the order, wrong design, defect): free remake at your cost (we provide the label), or the refund is deducted from your earnings.
  • Customer sizing error (set matches the order): the customer may order a discounted remake. You are paid the discounted price minus the normal commission. [Decision for Ryan: who absorbs the discount, the artist, Sets by Hand, or split.]
  • Damage in transit: if your proof photos show the set was packed properly, Sets by Hand covers the cost. If packing was poor, it's treated as your error.

10. Content and designs

10.1 You own your designs. You keep all rights to your designs, photos and shop content.

10.2 License to us. You give Sets by Hand a non-exclusive, worldwide, royalty-free license to host, display, copy (for display), resize, and share your designs, photos, shop name and content on the site, in emails, and in our marketing and social media, so we can promote your shop and the marketplace. This license lasts while your content is on Sets by Hand, and for a reasonable time after you remove it (for example, posts already published on social media don't have to be deleted). We'll credit your shop where practical.

10.3 Your promise. You promise that you own or have permission to use everything you upload, and that it follows our Content and Upload Rules. No copied designs from other artists, no copyrighted characters, logos or trademarks, and no adult content.

11. Off-platform deals

Please don't ask customers that Sets by Hand found for you to order outside the site to avoid commission, for [12] months after their first order with you. Doing so may lead to suspension. Customers who find you on your own are yours, and you can sell to them anywhere.

12. Reviews

Customers who buy from you can leave reviews. You may reply publicly and politely. You may not offer discounts, freebies or anything else in exchange for reviews, ask only happy customers to review, pressure customers to change reviews, or post reviews of your own shop. See our Reviews Policy.

13. Taxes

13.1 Income tax. You are responsible for reporting and paying your own income and self-employment taxes. Stripe may send you a Form 1099-K if you meet IRS or state reporting thresholds. Keep your tax information in Stripe accurate.

13.2 Sales tax. For orders placed on Sets by Hand, we collect and send sales tax as a marketplace facilitator where the law requires it. You don't need to collect sales tax on those orders. You are responsible for sales tax on sales you make outside Sets by Hand.

14. Suspension and ending these terms

14.1 Your choice. You can stop selling at any time. Finish or cancel open orders first. We'll pay out remaining earnings after the normal hold periods and any open claims are resolved.

14.2 Our choice. We may warn, limit, pause, or close your shop if you:

  • Break these Seller Terms, our Content and Upload Rules, or the law.
  • Have repeated quality problems, late shipments, missing proof photos, or cancellations.
  • Copy other artists' designs or have repeated infringement reports (see our Content and Upload Rules).
  • Harass customers or our team.
  • Commit or attempt fraud, including fake reviews or fake orders.

Where we reasonably can, we'll tell you why and give you a chance to fix the problem first. For serious issues (fraud, safety, illegal content), we may act right away. You can appeal by emailing [EMAIL] within 14 days.

15. Liability

You are responsible for the sets you make and sell, including their safety and materials disclosures. You agree to cover our reasonable costs (including reasonable legal fees) from claims caused by your products, your content, or your breach of these Seller Terms or the law. The limitation of liability in our Terms of Service also applies to Sets by Hand's liability to you, and our total liability to you is limited to the commission we earned from your orders in the 6 months before the claim.

16. Changes

We may update these Seller Terms. We'll email you at least 30 days before important changes take effect (14 days for other changes). If you keep selling after that, you accept the update.

17. Governing law and disputes

These Seller Terms are governed by Connecticut law. Disputes are handled as described in the Disputes section of our Terms of Service.

18. Text messages

We text you sign-in codes when you ask for one. If you tick the text box when you claim your shop, we also text you about new orders, reminders to accept or ship, and payouts. Reply STOP to stop the order texts, HELP for help. Message and data rates may apply. Full details are in section 17 of our Terms of Service ("Text messages").
