Sets by Hand Content and Upload Rules

Last updated: [DATE]

The short version

  • Only upload designs and photos that are yours.
  • No copying other artists. No cartoon characters, team logos, brand names, or adult content.
  • If someone copied your design, tell us and we'll look into it fast.
  • If we take your design down by mistake, you can push back with a counter-notice.
  • Artists who keep breaking these rules lose their shop.

1. Who these rules apply to

These rules apply to anything uploaded or sent to Sets by Hand: design photos, listing text, shop names and banners, claim photos, and (when reviews open) reviews and review photos. They apply to artists and customers.

2. Design ownership

When you upload a design, you are promising that:

  • You created the design yourself, or you have written permission from the person who did.
  • The photos are your own photos of sets you made. No stock photos, no photos taken from other shops, Pinterest, Instagram, TikTok or anywhere else.
  • Your listing describes the set honestly.

Inspired vs copied. Nail art trends (like French tips, chrome, or florals) are shared by everyone, and taking inspiration is fine. Copying is not. A design is copied when it reproduces another artist's specific, original work closely enough that a reasonable person would think it's the same design, or when you use someone else's photo of their work. When in doubt, make it your own or ask the artist for permission.

3. Prohibited content

Don't upload or sell:

  1. Copied designs or stolen photos from other artists or shops.
  2. Copyrighted characters (for example, cartoon, anime, movie or video game characters) unless you have a license.
  3. Logos and trademarks (for example, sports teams, luxury fashion brands, school logos, sneaker brands) unless you have a license.
  4. Images of real people (celebrities or otherwise) without their permission.
  5. Adult content: nudity, sexual content, or sexually suggestive designs.
  6. Hate or harassment: content that attacks people based on race, ethnicity, religion, gender, sexual orientation, disability, or similar traits.
  7. Violence or illegal activity: content promoting violence, drugs, or other illegal acts.
  8. Misleading content: fake listings, false claims about materials (for example, "non-toxic" or "hypoallergenic" without a basis), or photos of sets that aren't yours.
  9. Personal information: other people's addresses, phone numbers, or private details.
  10. Spam and links that send customers off the site to buy (except as allowed in the Seller Terms).

We may remove content that breaks these rules, and we decide what fits our community. Removing content doesn't make us responsible for content we don't remove.

4. Reporting a copied design

If you're an artist and you think a design on Sets by Hand copies your work, you can report it even if you don't sell on Sets by Hand.

4.1 Quick report (any copying concern). Use the "Report" button on the listing, or email [EMAIL] with:

  • A link to the listing on Sets by Hand.
  • A link or photo showing your original design, with the date you first posted it if you can.
  • A short explanation.

We'll review quick reports within [3] business days and may remove the listing, ask the artist to explain, or decide no action is needed.

4.2 Formal copyright notice (DMCA). If you own the copyright in a design or photo and want to send a formal notice under the Digital Millennium Copyright Act, send it to our designated copyright agent:

Copyright Agent, [COMPANY LLC] [MAILING ADDRESS] [COPYRIGHT EMAIL]

Your notice must include:

  1. Your physical or electronic signature.
  2. A description of the copyrighted work you say was copied.
  3. The link(s) to the content on Sets by Hand you want removed.
  4. Your name, address, phone number and email.
  5. A statement that you have a good faith belief the use isn't authorized by you, your agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act for the owner.

Please be honest. Under the law, you may be liable for damages if you knowingly misrepresent that content is infringing.

5. What happens after a notice

When we receive a valid notice, we'll:

  1. Remove or disable the content promptly.
  2. Tell the artist or user who uploaded it, and share a copy of the notice (we may remove personal contact details where the law allows).
  3. Record the notice toward our repeat infringer policy.

6. Counter-notice (if you think we got it wrong)

If your content was removed and you believe it was a mistake or you have the right to use it, you can send a counter-notice to our copyright agent at the address above. It must include:

  1. Your physical or electronic signature.
  2. A description of the content that was removed and where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the content was removed by mistake or misidentification.
  4. Your name, address and phone number.
  5. A statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the US, any judicial district where [COMPANY LLC] may be found), and that you will accept service of legal process from the person who sent the original notice.

When we receive a valid counter-notice, we'll forward it to the person who filed the original notice. If they don't tell us within 10 to 14 business days that they've filed a court action, we may restore the content.

For quick reports (section 4.1) that aren't formal DMCA notices, you can simply reply to our email with your explanation and proof of your original work.

7. Repeat infringer policy

We take repeated copying seriously:

  • First valid notice or confirmed copy: content removed and a written warning.
  • Second: content removed and shop paused for [14] days.
  • Third: shop and account permanently closed.

Notices count toward this policy over any rolling 12-month period. We may skip steps and close a shop right away for clear, deliberate or large-scale copying. Notices that are successfully countered don't count.

8. Your content license

Who owns what, and the license you give us to display your content, is explained in our Terms of Service (for customers) and Seller Terms (for artists).
